Appeal of Smaller Homes Is Growing

Taking It With You? Better Put It in the Contract.

"When you sell or buy a home, you need to think ahead about what you are actually selling along with the property and the house," says realtor John Day in the October issue of his informative Homes Buy Day newsletter. You don't want to wind up arguing with the buyer or seller about what goes and what stays. In real estate, petty disagreements have a way of spreading to other, more important issues and can even jeopardize the sale, John warns.

The general rule of thumb is: If it's attached to the structure or the ground, it is real property, not personal property, and stays with the house, John explains. This means curtain rods and drapes, which are attached to the wall, are real property and stay with the house. This also applies to chandeliers, wall sconces, gas fireplace logs, even the basketball hoop screwed into the side of the garage.

So what do you do if you want to take one of these items with you, maybe the bedroom curtains that match your linens? You specify it in the contract, says John.
